NEW JERSEY CARPENTERS UNITED

PREAMBLE

Our aim will be to promote and protect the interest of the membership, to elevate the moral, intellectual and social conditions of all working men and women, to assist each other in sickness and distress,

To discourage piecework, to encourage apprenticeship and a higher standard of skill, to cultivate a feeling of friendship, and to assist each other to secure employment,

To aid and assist all organizations to uphold the dignity of labor, resist oppression by peaceful and honorable means,

To hold it as a sacred principle, that union members, above all others, should set a good example as true and faithful workers, performing their duties to their employer with honor to themselves, and to their organization.

We resent the principle of open shop association, and will continually strive for the enactment of legislation which will enable us to achieve our objectives.

Realizing that a blow at one organization is a blow to all, therefore, it shall be our duty as union members to purchase union-made goods and patronize union shops and business establishments whenever possible to do so.

So with these aims and principles in mind, we, the Carpenters of the vicinity of ________________, New Jersey affiliate ourselves into an organization that shall be known as Local Union ____ of New Jersey Carpenters United, in conformity with the provisions of the Constitution and Laws of New Jersey Carpenters United.

BY-LAWS

Section 1. This organization shall be known as Carpenters’ Local Union No. ____ of New Jersey Carpenters United.

Section 2. We shall hold our regular meetings at ___________________________, New Jersey at 8P.M. on the first Monday of each month. No business shall be transacted after 11:00 P.M. unless by majority vote of the members present immediately after reading of the minutes.

Section 3. The territorial jurisdiction of this Local Union shall be one-half the distance towards the next nearest Local Union of New Jersey Carpenters United, unless otherwise established as provided for by the Constitution and Laws of New Jersey Carpenters United

Section 4. The nomination, election and installation of officers of this Local Union shall be in conformity with the Constitution and Laws of New Jersey Carpenters United.

Section 5. The duties of the officers of this Local Union shall be as set forth in the Constitution and Laws of New Jersey Carpenters United.

Section 6. The initiation fee of apprentices shall be as set forth in the Constitution and Laws of New Jersey Carpenters United.

Section 7. The initiation fee for applicants to join this Local Union shall be $250.00. Arrangements may be made for payment of the initiation fee in installments.

Section 8. Applicants for membership shall be bound by the provisions of the Constitution and Laws of New Jersey Carpenters United and by the By-Laws of this Local Union.

Section 9. Members of other Local Unions coming to work in this jurisdiction shall be governed by  the Constitution and Laws of New Jersey Carpenters United.

Section 10. No officer or member of this Local Union shall be exempt from the payment of dues and assessments under any pretense whatsoever.

Section 11. All Committees and Delegates of this Local Union shall perform the duties assigned to them.

Section 12. No member shall be compelled to serve upon more than one Committee at the same time.

Section 13. Special Committees may be appointed by the President of the Local Union.

Section 14. Remuneration, if any, shall be decided by the Local Union at the time the members of the Committees are selected.

Section 15. Any member of a Committee failing to perform his or her duties may be removed from such Committee by the President.

Section 16. The monthly dues of this Local Union shall be a minimum of 1½ hours of journeyman’s pay, to the nearest $.25 on a fraction of a dollar, which must be an adequate sum to enable the Local Union to operate in an efficient, proper and solvent manner in the service and best interest of its membership. The dues shall be paid as required to the Financial Secretary of this Local Union.

Section 17. The fiscal year of this Local Union shall be July 1 to June 30. All accounts shall be audited and a complete financial report for the fiscal year be brought forth by the auditing committee no later than ninety days following the close of the fiscal year.

BY-LAWS OF LOCAL UNION NO. ____

Section 1. This organization shall be known as Carpenters’ Local Union No. ____ of New Jersey Carpenters United.

Section 2. We shall hold one regular meeting a month, at ______________________________, New Jersey on the first Monday of each month at 8:00 P.M.For any reason the regular meeting be canceled it will be held on the 2nd Monday of the month and, if possible, cancelation will be aired on the local radio station. No business shall be transacted after 11:00 P.M. unless by majority vote of the members present immediately after the reading of the minutes.

Section 3. The territorial jurisdiction of this Local Union shall be one-half the distance towards the next nearest Local Union of New Jersey Carpenters United, unless otherwise established as provided for by the Constitution and Laws of New Jersey Carpenters United.

Section 4. The nomination, election and installation of officers of this Local Union shall be in conformity with the Constitution and Laws of New Jersey Carpenters United.

Section 18. The salaries or expenses allowed for the Officers of Local Union No. ____ shall be set at the discretion of the Local Union.

Section 19. Special meetings shall be called by the President upon the written request of five members in good standing. When a special called meeting is called on a regular meeting night, a special time shall be set for the special business. Upon the completion of the special business, any other business that may come before the meeting will be conducted.

Section 20. Fifteen members in good standing shall constitute a quorum.

Section 21. The order of busiess of this Local Union and the Parliamentary Rules governing the conduct of our meetings, shall be as set forth in the Constitution and Laws of New Jersey Carpenters United.

Section 22. The General Consitution and Laws of New Jersey Carpenters United shall be a part of these By-Laws. All provisions therein pertaining to Local Unions shall be strictly adhered to.

NOTE: Local Unions affiliated with a District Council shall observe the Laws of the District Council.

QUALIFICATIONS FOR MEMBERSHIPS

Section 1. Any person seeking membership in Local Union ____ shall appear before the Examining Committee of Local Union ____ and show proof as to his qualifications for membership. The President shall appoint the Examining Committee. Section 2. Every apprentice application shall be in conformance with the provisions set forth in the Constitution and Laws of New Jersey Carpenters United.

Section 3. The application of the candidate must be presented to the Financial Secretary, with the full initiation fee, and a sum equal to three month’s dues. Action will be taken according to provisions set forth in the Constitution and Laws of New Jersey Carpenters United.

Section 4. Members who contract work or become foremen must comply with the Constitution and Laws of New Jersey Carpenters United.

Section 5. Any member incapacitated by age or accident may be permitted to obtain employment under regular scale of wages by obtaining a Privilege Card with the consent of a majority vote of the members present at a regular meeting of Local Union ____.

FINANCES AND DUES

Section 1. The monthly dues of apprentices of Local Union ____ shall be 66 2/3% of the journeyman’s dues. In the event that part of the dues amounts to a fraction of a dollar, the dues shall be established on the basis of the nearest twenty-five cents.

Section 2. A member three months in arrears shall not be entitled to the password, or a seat, or office in any meetings of Local Union ____, and the Financial Secretary shall read the names of all brother members who are 3 months in the arrears. A three dollar fine will be imposed for each late notice sent.

Section 3. A member who owes a Local Union five months dues shall be notified by mail, in address correction envelopes at the last known address by the Financial Secretary not later than the 15th day of the sixth month of said arrearage. Unless dues are paid by the end of the sixth month, the member’s name shall be stricken from the list of membership without a vote of the Local Union.

Section 4. A member of Local Union No. _____not able to work at the trade due to illness, infirmity or old age, shall be permitted by a vote of the members of Local Union No. ____ to pay a reduced rate of dues equivalent to the minimum dues as called for in the General Constitution. Any member requesting this reduced rate must be in good standing at the time of request. All monthly dues are to be governed by Local finances and may be increased or decreased when necessary.

Section 5. There shall be a Relief and Contingent Fund established in the Local Union. Local Union ____ may levy an assessment for this fund in accordance with the provisions set forth in the Constitution and Laws  governing special assessments.

ELECTIONS

Section 1. The officers of this Local Union shall be a President, Vice-President, Recording Secretary, Financial Secretary, Treasurer, Conductor, Warden and three Trustees. The officers shall constitute the Executive Committee of this Local Union. The Business Representative and Deputy Business Representative who are not members of the Executive Committee, shall attend the meetings of the Executive Committee with voice but without vote.

Section 2. The necessary qualifications for officers, delegates, Business Representative shall be in compliance as to the provisions set forth by the Constitution and Laws of New Jersey Carpenters United.

Section 3. The nominations of officers, delegates, Business Representative and Deputy Business Representative shall be held on a special called meeting in May and Election shall be held on a special called meeting in June.

Section 4. The installation of officers, delegates, Business Representative and Deputy Business Representative shall take place on the first meeting in July. In case an officer does not appear for the installation within two regular meetings thereafter, the office must be declared Vacant.

Section 5. The term of office for all elected officers, delegates, Business Representative and Deputy Business Representative shall be three years or until their successors are elected, qualified and installed. Neither the President, Treasurer, Financial Secretary nor Recording Secretary can act as Trustee.

Section 6. No member shall be permitted to hold more than one office in this Local Union.

Section 7. Electioneering shall not be permitted during voting hours in the building in which the election is being held.

EXECUTIVE COMMITTEE

Section 1. The officers of the Executive Committee shall be elected officers of the Local Union.

Section 2. The duties of the Executive Committee shall be as follows: To transact all business of an emergency nature between Local Union meetings, and to recommend all other matters of business to Local Union____for their approval.

Section 3. Seven members of the Executive Committee shall constitute a quorum for the transaction of business.

Section 4. The President shall have the power to order the Recording Secretary to call special Executive Committee meetings when requested by the Chairman of the Executive Committee or when requested in writing by five members in good standing of Local Union____.

Section 5. Charges against brother members for violations under the General Constitution or for violation of Local ByLaws or Trade Rules shall be first brought before the Executive Committee for a hearing, and then in accordance with the Constitution and Laws of New Jersey Carpenters United.

Section 6. The President, by virtue of his office, shall be a delegate to all conventions, National, State, County Building Trades, County Labor Council, etc., if more than one delegate is required.

BUSINESS REPRESENTATIVE

Section 1. The Business Representative shall give his official report at each meeting of the Local Union.

Section 2. Although the Business Representative is elected by the members of Local Union No._____for three years, his services may be terminated for any violation or infraction of the By-Laws, Trade Rules or misconduct in office, and shall be handled as prescribed in Section 32C of the Constitution and Laws of New Jersey Carpenters United.

Section 3. It shall be the duty of the Business Representative to maintain office hours from 8A.M. to 10A.M. daily and at such other times, as he, or Local Union No.______deems it advisable, to further the interest of our members at large. It shall be his duty to visit all jobs and shops, investigate and settle all complaints if not of such a serious condition that they require action by Local Union No._____. He shall examine dues books of members from outside our jurisdiction who come to work in this territory and to issue working permits when necessary.

Section 4. The Business Representative shall appoint a steward on each job and in every shop, and shall select the steward from the members that are in the group going to man the job. It shall be the duty of the Business Representative to replace the steward failing in, or neglecting his duties as set forth in our Trade Rules.

Section 5. The Business Representative shall be paid by Local Union No._____a minimum of Foreman’s pay (Carpenter) and his expenses shall be determined and paid by Local Union No._____.

Section 6. The Business Representative shall receive sick pay for three weeks, any additional pay shall he determined by the Local Union he represents upon receipt of a Doctor’s Certificate. He shall also receive two weeks vacation with pay. Vacation shafl not be cumulative.

Section 7. The Business Representative by virtue of his office shall be a delegate to all conventions, County Building Trades and County Labor Council.

Section 8. When the Business Representative is absent from his office, due to sickness, vacation or convention call, the Deputy Business Representative shall fulfill the duties of his office. If Business Representatives are unavailable then go to officer protecol.

Section 9. Any officer taking over Business Representative’s job shall receive Business Representative’s pay and expenses per day when performing the duties of the Business Representative.

STEWARDS

Section 1. A member as steward on a job or shop must be a member of Local Union No._____for a period of one year and in good standing subject to availability.

Section 2. The Shop Steward shall:

A. Examine referral cards, dues books and work cards of all members on the job.

B. Notify the Union office of the presence of any workers whose books are not in good standing.

C. Protect the interest of all members at all times.

D. Handle all grievances on the job reported to him by members or personally observed and report same to the Business Representative.

E. See that any member taken ill or hurt on the job is properly cared for and that his tools and personal belongings are taken care of.

F. Report any such occurrences by written report to the Local Union.

G. Make all welfare and pension reports.

H. Job Stewards are required to attend all Union meetings unless prevented by accident or sickness. Job Stewards failing to attend two consecutive meetings of Local Union No._____shall be replaced by the Business Representative.

I. Stewards working for the general contractor shall oversee the stewards of the subcontractors for safety of all working on the job.

Section 3. No Foreman shall be allowed to act as Steward.

These By-Laws shall null and void all previous By-Laws of Local Union No._____.
